Terms of Use

These Terms of Use (“Terms”) govern your use of the Audio Pen applications on iOS, iPadOS, macOS, and Android. By downloading or using Audio Pen, you agree to these Terms.

1. The service

Audio Pen is a voice-to-text notes app. Free features include on-device dictation and local note management. Optional Power Features (translate, PDF export, attach images, read text from images, custom folder icons, and AI dictation with your own GROQ key) may require a paid subscription purchased through the Apple App Store or Google Play.

2. Your responsibilities

  • You are responsible for the content you create, attach, or export.
  • You must not use Audio Pen for unlawful, harmful, or abusive purposes.
  • If you supply a GROQ API key, you are responsible for that key, usage costs charged by Groq, and compliance with Groq’s terms.
  • You must keep your device and OS reasonably up to date for security and compatibility.

3. Accounts and anonymity

Core note-taking does not require a traditional email/password account. The app may maintain an anonymous install record to support subscriptions and product operation. You agree not to abuse reset, restore, or subscription flows.

4. Subscriptions and payments

  • Paid plans are billed by Apple or Google under their payment terms.
  • Prices, plan lengths, and free trials (if any) are shown in the app store product page and paywall at purchase time.
  • Manage or cancel renewals in your Apple ID or Google Play subscription settings.
  • Refunds are handled by Apple or Google according to their policies.

5. Intellectual property

Audio Pen, its name, branding, and software are owned by us or our licensors. You keep ownership of the notes and media you create. You grant us only the limited rights needed to operate features you choose (for example processing audio for transcription).

6. Third-party services

Features may rely on Apple, Google, Groq, or other providers. Those services have their own terms. We are not responsible for outages or policy changes of third parties.

7. Disclaimer of warranties

Audio Pen is provided “as is” and “as available.” We do not guarantee uninterrupted operation, perfect transcription accuracy, or that AI or on-device engines will meet every need. Use critical results with your own judgment.

8. Limitation of liability

To the maximum extent allowed by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of notes, profits, or data, arising from your use of the app. Our total liability for any claim relating to the app will not exceed the amount you paid us for the app in the twelve months before the claim (or zero if you only used free features).

9. Termination

You may stop using Audio Pen at any time by deleting the app. We may suspend or discontinue the app or features with reasonable notice when practical. Sections that should survive (such as liability limits) continue after termination.

10. Changes to these Terms

We may update these Terms. The “Last updated” date will change when we do. If you continue using Audio Pen after changes take effect, you accept the new Terms.

11. Governing law

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the courts at Bangalore, Karnataka, India.
